These Terms and Conditions ("Terms") govern your use of the Running Creek Lavender, LLC website at https://runningcreeklavender.com/ (the "Website") and your purchase of tickets for our pick-your-own lavender farm experience (the "Experience"). By accessing or using the Website or purchasing tickets, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Website or purchase tickets.
Eligibility
By using the Website and purchasing tickets, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. Minors may attend the Experience only when accompanied by a parent or legal guardian who has accepted these Terms and purchased tickets on their behalf.
Ticket Purchases
All ticket purchases are made through our Website. To purchase tickets, you must provide accurate and complete contact information, including your name, email address, and phone number. Upon completion of your purchase, your tickets will be delivered to you via email or text message, as selected during checkout. You are responsible for ensuring that the contact information you provide is accurate and that you are able to receive messages at the email address or phone number you supply.
Tickets are valid only for the date and time indicated on the ticket. Each ticket admits one person to the Experience. Tickets are non-transferable except as expressly permitted by us in writing. You must present your valid ticket (electronically or in printed form) upon arrival at the farm. We reserve the right to refuse entry to any person who does not present a valid ticket.
Pricing and Payment
All prices listed on the Website are in U.S. dollars and include applicable taxes unless otherwise stated. We reserve the right to change pricing at any time without prior notice, provided that any price changes will not affect tickets that have already been purchased. Payment must be made in full at the time of purchase using an accepted payment method as indicated on the Website. All payments are processed by our third-party payment processor, and your use of the payment processor is subject to its terms and conditions.
Refund and Cancellation Policy
All ticket sales are final. No refunds will be issued for any reason, including failure to attend your scheduled visit (“no-shows”) or voluntary cancellation by the ticket holder.
The Experience is offered on a weather-permitting basis. We reserve the right to cancel or modify the Experience at any time due to weather conditions, farm conditions, or other circumstances beyond our reasonable control. In the event we cancel the Experience due to weather or other conditions, no refunds will be issued. We will make reasonable efforts to notify you of any cancellation by email or text message using the contact information you provided at the time of purchase. By purchasing a ticket, you acknowledge and accept that the Experience is subject to cancellation due to weather and that no refund will be provided in such circumstances.
Farm Rules and Visitor Conduct
All visitors to our farm must comply with the following rules of conduct while on our property. You must remain in designated areas at all times and follow all posted signs and instructions from farm staff. Picking of lavender is permitted only in areas designated for the Experience and in accordance with instructions provided by farm staff. Children must be supervised by a parent or legal guardian at all times. Pets are not permitted on the property. Smoking, the use of open flames, and the consumption of alcohol (except as sold on the premises, if applicable) are prohibited.
We reserve the right to ask any visitor to leave the property at any time if, in our sole discretion, such visitor is engaging in unsafe, disruptive, or inappropriate behavior. No refund will be provided if a visitor is asked to leave for a violation of these rules.
Assumption of Risk
The Experience takes place in an outdoor agricultural setting. By purchasing a ticket and visiting our farm, you acknowledge and agree that participation in the Experience involves inherent risks, including but not limited to exposure to uneven terrain, insects, allergens (including but not limited to pollen and plant allergens), sun exposure, heat-related illness, and contact with farm equipment. You voluntarily assume all risks associated with your visit to the farm and participation in the Experience.
Under North Carolina's Agritourism Activity Liability Act (N.C. Gen. Stat. § 99E-30 et seq.), an agritourism professional is not liable for injury to or death of a participant resulting from the inherent risks of agritourism activities. You acknowledge that you have been informed of this limitation of liability and that you are voluntarily participating in the Experience with full knowledge of the inherent risks involved.
Limitation of Liability
To the fullest extent permitted by applicable law, Running Creek Lavender, LLC, its owners, officers, employees, agents, and affiliates (collectively, the "Farm Parties") shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Website, your purchase of tickets, or your participation in the Experience, regardless of the theory of liability.
To the fullest extent permitted by applicable law, the total aggregate liability of the Farm Parties for any claims arising out of or related to these Terms, the Website, or the Experience shall not exceed the total amount you paid for your ticket(s).
Disclaimer of Warranties
The Website and the Experience are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, the Farm Parties disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Website will be uninterrupted, error-free, or free of viruses or other harmful components.
Intellectual Property
All content on the Website, including but not limited to text, graphics, photographs, logos, trademarks, and software, is the property of Running Creek Lavender, LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from the Website without our prior written consent.
Indemnification
You agree to indemnify, defend, and hold harmless the Farm Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Website, your purchase or use of tickets, your participation in the Experience, your violation of these Terms, or your violation of any applicable law or the rights of any third party.
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms, the Website, or the Experience shall be resolved exclusively in the state or federal courts located in Stanly County, North Carolina, and you consent to the personal jurisdiction of such courts.
Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms, and the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms, together with the Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and Running Creek Lavender, LLC with respect to the subject matter hereof and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral.
